This website is operated by The PP Cup. Throughout the site, the terms "we", "us" and "our" refer to The PP Cup. These Terms of Service ("Terms") govern your use of this website and every purchase you make from us.

1. Acceptance of These Terms

By visiting our site or placing an order, you agree to be bound by these Terms and by the other policies posted on this site, including our Return & Refund Policy and Privacy Policy. If you do not agree, do not use the site or place an order.

Placing an order confirms that you have read and accepted these Terms and our Return & Refund Policy as they stood on the date of your order.

2. Online Store Terms

• Our products are novelty adult-humor gifts intended for adults. You confirm that you are at least 18 years old and the age of majority where you live.
• You may not use our site or products for any illegal or unauthorized purpose.
• You agree to provide current, complete and accurate information for every order, including your name, email, billing details and shipping address.

3. Products

Certain products may be available only online and in limited quantities. We may limit the sale of any product to any person, region or jurisdiction, and we may discontinue any product at any time.

We display our products as accurately as we can. Our mugs are blown glass, so small differences in shape, size, thickness and color, and tiny bubbles in the glass, are normal and are not defects.

Packaging may differ from what appears in photos, videos or advertising. Drinks, props and other items shown with the product are not included.

4. Orders, Pricing & Billing

Prices are subject to change without notice. The price you pay is the price shown at checkout when you place your order.

By placing an order, you confirm that you are authorized to use the payment method provided, and you authorize us to charge it for the full order total. This includes shipping charges and any add-ons selected at checkout, such as the 30-Day Warranty.

We may refuse or cancel any order at our sole discretion, including orders involving suspected fraud, unauthorized payment, pricing or listing errors, or resale. If we cancel an order that has already been charged, we will refund the amount paid.

We may correct errors in product descriptions, pricing or availability at any time, including after an order has been submitted.

5. Shipping & Delivery

Shipping and delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other events outside our control.

You are responsible for entering a correct and complete shipping address. We are not responsible for orders delayed, lost or returned because the address entered at checkout was wrong or incomplete.

An order is considered delivered and fulfilled when the carrier marks it as delivered to the address provided at checkout. Responsibility for the package passes to you at that point.

Any import duties, taxes or customs fees are the customer's responsibility.

6. Returns, Refunds & Warranty

All sales are final except as stated in our Return & Refund Policy, which forms part of these Terms. That policy governs damaged, defective or incorrect items, the 30-Day Warranty add-on, order changes and cancellations.

7. Chargebacks & Payment Disputes

If there is a problem with an order, you agree to contact us first at instantscreen8@gmail.com and give us a reasonable opportunity to resolve it before disputing the charge with your bank or card issuer.

If a chargeback or payment dispute is filed, we may share your order details, proof of delivery, IP address and device information, your acceptance of these Terms, and our correspondence with the payment processor and card issuer in order to contest it.

A dispute decided in our favor leaves the original charge in place. If a dispute results in the charge being reversed, any 30-Day Warranty on that order is void.

We reserve the right to refuse future orders from anyone who files a dispute that we determine to be unfounded or fraudulent.

8. Electronic Communications

By placing an order, you consent to receive order confirmations, shipping updates and other transactional messages by email. You agree that these messages satisfy any requirement for written notice.

You are responsible for providing a working email address. We are not responsible for messages you do not receive because of an incorrect address or a spam filter.

9. Reviews & Submissions

If you send or post reviews, photos, videos, comments or suggestions, you grant us a non-exclusive, royalty-free, perpetual right to use, edit and publish them in any medium, including advertising, without compensation.

You confirm that anything you submit is your own, is accurate, and does not violate anyone else's rights. We may remove any submission at our discretion.

10. Intellectual Property

All content on this site, including images, video, text, logos and designs, is the property of The PP Cup or its licensors. It may not be copied, reproduced or used without our written permission.

11. Prohibited Uses

You may not use this site or its content to:

• Break any law or regulation
• Submit false or misleading information
• Place an order with a payment method you are not authorized to use
• Infringe our intellectual property rights or those of others
• Upload or transmit viruses or other malicious code
• Scrape the site or collect the personal information of others
• Interfere with or bypass the site's security features

We may terminate your access to the site for violating any of these.

12. Third-Party Links & Tools

Our store is hosted on Shopify Inc., and the site may link to or rely on other third-party websites, payment processors and tools. We do not control them and are not responsible for their content, products or practices. Your use of them is at your own risk and subject to their own terms.

13. Disclaimer of Warranties

Except for the 30-Day Warranty add-on described in our Return & Refund Policy, and to the fullest extent permitted by law, our site and products are provided "as is" and "as available" without warranties of any kind, express or implied. This includes implied warranties of merchantability and fitness for a particular purpose.

We do not guarantee that the site will be uninterrupted, secure or error-free.

14. Limitation of Liability

To the fullest extent permitted by law, The PP Cup and its owners, employees, suppliers and service providers are not liable for any indirect, incidental, special, punitive or consequential damages arising from your use of the site or of any product.

Our total liability for any claim is limited to the amount you paid for the order the claim relates to.

Some jurisdictions do not allow these limits. In those jurisdictions, our liability is limited to the maximum extent the law permits.

15. Indemnification

You agree to indemnify and hold harmless The PP Cup and its owners, employees, suppliers and service providers from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of a product, or your violation of any law or the rights of a third party.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules.

Before starting any legal claim, you agree to contact us and allow 30 days for us to resolve the issue informally. Any legal action must be brought in the state or federal courts located in New Jersey.

To the extent permitted by law, claims must be brought on an individual basis and not as part of a class or group action.

17. General Terms

• If any part of these Terms is found to be unenforceable, the rest remains in full effect.
• These Terms and the policies posted on this site are the entire agreement between you and us and replace any earlier agreements or communications.
• If we do not enforce a right or provision of these Terms, that is not a waiver of it.
• Headings are for convenience only and do not limit or affect these Terms.

18. Changes to These Terms

We may update these Terms at any time by posting the new version on this page. The version in effect on the date of your order applies to that order. Your continued use of the site after a change means you accept the updated Terms.
